1. Agreement
These Terms of Service ("Terms") are an agreement between you and Ashford Digital Group LLC, a Kentucky limited liability company ("Ashford", "we", "us"). They apply to this website and to the products we operate, including CheatSpyder, GumSearch, LeadSniper, Noise Reporter and Bloomlet (the "Services"). By using the Services you agree to these Terms. If a product publishes its own terms, those product terms also apply and take precedence for that product.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide, for keeping your login details secure, and for all activity under your account.
3. The Services
We may update, improve or discontinue features from time to time. Products marked "Coming soon" are not yet available and do not accept payments. Some Services provide information drawn from publicly available sources; such information is provided for general informational purposes, may be incomplete or out of date, and is not a statement of fact about any person.
4. Prices and payments
Prices are shown in U.S. dollars before purchase, together with the billing period and renewal terms. Applicable taxes are calculated at checkout. Card payments are processed by Stripe, Inc., and Stripe's terms also apply to the transaction. We do not store full payment card numbers.
5. Delivery of digital products
All of our products are digital. Nothing is shipped. Access is delivered online immediately after payment is confirmed, and a receipt is sent to the email address used at checkout. If you have paid but cannot access what you bought within one hour, contact support and we will fix it or refund you.
6. Promotions, discounts and trials
Any promotion, discount code or free trial is shown with its conditions before you agree to it, including its length, the price that applies afterwards and how to cancel. Unless stated otherwise, a trial converts to the paid plan shown at sign-up at the end of the trial period, and you can cancel before then without being charged. Promotions cannot be combined unless stated, and have no cash value.
7. Subscriptions, renewals and cancellation
Subscription plans renew automatically at the end of each billing period at the price shown at purchase, unless you cancel before the renewal date. Before you subscribe, we show the price, how often you will be charged, that the plan renews until cancelled, and how to cancel, and we ask for your express agreement. After purchase we email a confirmation with the same information.
You can cancel at any time online in your account settings, by email or by phone, and online cancellation is always available without needing to contact us. Cancellation stops future charges; you keep access until the end of the current paid period. We send a reminder before renewal where the law requires it, and at least once a year for plans that renew annually or longer. If we change the price of a plan, we will tell you in advance and the new price applies only from your next renewal, which you can cancel before it takes effect. Refunds are governed by our Refund & Cancellation Policy.
8. Software development services
When you hire us to design, build or launch a product ("Build with us"), a written proposal or statement of work sets out the scope, price, milestones and ownership of the work. For that project it takes precedence over these Terms if they conflict. Unless the proposal says otherwise: work starts after a 50% deposit; the balance is due on delivery of the first release; invoices are issued in U.S. dollars, are payable within 14 days and are paid by card or bank transfer through Stripe.
Code and other deliverables created for your project transfer to you once paid in full, except our pre-existing tools and components, which we license to you for use with the product. If you own the product, its customer payments are processed through a payment account in your own name; Ashford does not collect payments on your behalf. Optional monthly plans for hosting, payments operations and support are billed monthly and can be cancelled with 30 days' notice. Refunds for services are covered in our Refund & Cancellation Policy.
9. Acceptable use
You must use the Services lawfully and in line with our Acceptable Use Policy, which forms part of these Terms. We may suspend or terminate access if you breach it.
10. Not a consumer reporting agency
Ashford and its products are not consumer reporting agencies as defined by the U.S. Fair Credit Reporting Act (FCRA). You may not use the Services or any information obtained through them to make decisions about a person's eligibility for credit, insurance, employment, housing or any other purpose covered by the FCRA.
11. Intellectual property
The Services, including software, design, text, logos and trademarks, are owned by Ashford or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. You may not copy, resell, scrape or reverse engineer the Services except where the law allows it.
12. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that results will be accurate, complete or uninterrupted.
13. Limitation of liability
To the fullest extent permitted by law, Ashford will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Service in the 12 months before the claim.
14. Indemnification
You agree to indemnify and hold Ashford harmless from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms or applicable law.
15. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect users or third parties. Sections that by their nature should survive termination will survive.
16. Export controls and sanctions
You may not use the Services if you are located in, or are a resident of, a country or region subject to comprehensive U.S. sanctions, or if you are on a U.S. government list of restricted parties. You must not use or export the Services in breach of U.S. export control and sanctions laws.
17. Governing law
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict-of-law rules. Courts located in Kentucky have exclusive jurisdiction, except where consumer-protection law in your country of residence gives you the right to bring proceedings locally. Before starting any formal claim, please contact us so we can try to resolve the issue informally within 30 days.
18. Changes to these Terms
We may update these Terms. If changes are material, we will give notice on this page or by email before they take effect. Continued use after the effective date means you accept the updated Terms.
